A good
friend of mine owns Big Sam Moving Company (
www.BigSamMoving.com
). A few years ago, he
fired a temporary worker because he found out that another moving company fired
him for drug abuse, and for rifling through customer's belongings. The addict /
thief then retaliated by having a
more intelligent and articulate acquaintance of his file an
obviously false report against Sam's company on
www.RipOffReport.com
- and although
RipOffReport sounds like a good idea on its face, the owner of the site
does not check
reports for validity by his own admission, and refuses to remove demonstrably false entries even when
threatened by lawsuit. I have tried to get the report on my friend's company
removed for several years to no avail.... and it has been there since
3/21/2004. The company SAYS that rebuttals may be made to postings, but any
reports posted will NEVER be removed to prevent "extortion".
RipOffReport makes its
money by running what they call "Corporate
Advocacy, Business Remediation and Customer Satisfaction Program",
which costs both parties valuable time and money.
A statement on their site
claims "Of
course, like anything else worth having,
our CAP program is not
free. Someone needs
to pay to keep the lights on and the servers running, and so we charge a
reasonable fee for our time and expenses. If a company can show that it lacks
the resources to afford our standard rates, we are glad to offer our services
for a reduced price based on the company's financial condition".

Due to the fact that
RipOffReport is ITSELF an unscrupulous company that, like a shotgun, can be used
for good or evil, I have posted the following Ripoff Report on their own web

The original rebuttal I
filed against this OBVIOUSLY FALSE complaint was nowhere to be found, and so I
filed it again on Nov. 18, 2008. It is
reproduced along with the false report, below. RipOff
Report obviously screens rebuttals - so why can't they screen the complaints for

credibility if BULLSHIT posted by Techno-Terrorists looking to destroy a
company's reputation because they got fired for drug use... if those reports,
once challenged and proven libelous and slanderous, could be removed?). Well,
you supposedly CAN remove a bullshit Ripoff Report entry:

These people probably
have connections with or are operated by RipOffReport, and the two work hand-in-hand. Now
to be entirely honest, I don't
know this for a fact, but it stands to reason that it is a possibility. However,
I must in all fairness cite an axiom of the law:

The people who run
RipOffReport have appointed themselves guardians of the business universe, and
by their own admission, will not remove a posting on their site - even if it is
proven to be demonstrably false and libelous. They put
themselves in the same category as a court of law, claiming that destroying
records of false reports is "against their philosophy", and that
suing them is an exercise in futility.
Well, we have an answer
for them. THIS
PAGE IS PERMANENT AS WELL.
We believe that libel and slander, and those who aid and abet libel and slander
should be made to pay the price. If you slander me PERSONALLY, I have a legal
cause of action to drag your ass into court and make you pay "the last
farthing" as it says in the Good Book. It should be no different because the
libel and slander is done over the Internet, and the courts are - as they OFTEN
are - morally WRONG. "Freedom of Speech" as guaranteed by the First Amendment
should NOT hold parties after-the-fact immune from prosecution simply because
they are hosts of the medium that gives rise to unwarranted, unsubstantiated
LIES about another person or his business. The fact that someone OTHER than
you (RipOffReport) has posted the LIES about my company using a medium and a
forum you (RipOffReport) provided, makes you (RipOffReport) an accomplice to the crime - at
least, it should. But we live in a world full of Assholes, and we have come to
expect such things as the order of the day.... even from the nation's highest
courts, and it does not bode well for American Jurisprudence to permit the
precedent cases which encourage Libel and Slander by proxy, or Anonymous
Libelous and Slanderous postings to stand.
I run a network of Web
sites, and I am responsible for their content. I control every word written
here. If someone challenges my statements or content, I review it, and if I'm
proven to be wrong, I admit it and I will delete or modify the content
accordingly. If a Web site claims to be an advocacy for the consumer, it should
operate entirely on substantiated TRUTH, and summarily delete unmitigated
BULLSHIT, which the report - the ONLY complaint filed against Big Sam Moving
ANYWHERE - certainly is. This is not to say that Big Sam hasn't had some
problems - every business DOES - but when problems arise, Sam always goes out of
his way to resolve them. In fact, if Sam notices a piece of broken furniture in
a shipment moving through this warehouse - even if the piece was broken when it
was picked it up - he has an extensive woodworking shop on site, and as his
hobby, and in order to pleasantly surprise the customer, he repairs the broken
piece. When the customer receives the shipment at the destination, he wonders
how it got fixed "in transit", because he knew the piece left his house broken.

Please be advised that BIG SAM MOVING, located at 110 First Street in Jersey
City, NJ, is an unscrupulous company that regularly cheats its workers of wages
and customers of possessions.
The company is owned by Mr. Basam (last name unknown), who goes under the names
of Sam or Mike. He uses aliases when he doesn't have enough workers for a job
and goes himself to act as a helper, but does not want the client to know that
he is the company's owner.
As a former employee, I witnessed first-hand as
he stole items from customers
that were meant to be kept safe in storage. He stole tool
boxes and hand trucks
from customers and used them in his business. He
does not have insurance
available for his clients and when they request it, he claims that he must call
his broker, which would take too long. So, if anything gets broken, the customer
is only reimbursed for 60 cents per pound so a $3000, 100 pound television would
be reimbursed for just $60! In addition, Mr. Basam holds his workers financially
responsible for any damage that occurs in the course of moving, even if the
cause for the damage is unclear.
The storage, where customers' furniture is kept, is a
dilapidated warehouse
filled with rats and mice who regularly feast on the sofas and other stuffed
items that are kept there. Once, when I delivered furniture from the storage to
a customer's house, mice ran out from the sofa we were carrying. Naturally, the
customer was horrified!
Many of his workers are ex-convicts, recent immigrants, or homeless people who
have few resources and are therefore easily taken advantage of. These are often
desperate people who sometimes steal from the customers, since Mr. Basam is
reluctant to pay them their wages on time. If the customer complains about
theft, then Mr. Basam opens his own wallet and pays to reimburse the client, so
that no complaints will be filed against him or his company.
His wife, who answers the phone, always quotes the cheapest price possible to
the customer, pretending that a $1,000 job can be done $300 to $500. She does
not speak English well, which further confuses the customers. It is then up to
his foremen to inform the client about the realistic cost of the move, which
immediately causes conflicts between the clients and the movers. The hostility
is so extreme that on occasion the movers have had to call the police in order
to settle the contract for an amount that the client did not expect.
Sometimes Mr. Basam's wife negotiates a “flat-rate” contract – again for a
ridiculously low amount. Then, when the workers are confronted with a much
larger job than they expected, they have to work for less than minimum wage, as
they will only be paid a flat rate, no matter how
many hours the job actually takes. Often they work for 9 hours but are only paid for 5 the hours of work
enumerated in the contract.
On occasion, Mr. Barsam gets two workers to agree to “split” hours. In other
words, instead of one person working for $7 to $9 an hour, two people have to
split that and therefore only make $3.50 to $4.50 per hour apiece. These are
grown men, often with families to support. And the work is extremely difficult:
The men sometimes have to lift heavy furniture up 3 or 4 flights of stairs with
no elevator. He picks out these unfortunates by calling more people than he
needs, early in the morning, and then latest them wait for hours and hours until
a job may become available. If they wait long enough, he knows they're desperate
enough to work for almost nothing.
Many of his employees are drug addicts and dealers, because no one else will
remain in his employ for long. Mr. Basam sends these troubled, desperate people
into the homes of unsuspecting customers. Most people working in his company are
illegally employed and have no skills as movers. They tend to work for just a
couple of days to make some money, and then disappear.
When I was working for Mr. Basam,
I was considered a full-time employee, with
taxes withheld from my wages, However, I was never given a W4 form to fill out.
Mr. Basam told me that he was withholding Social Security tax and regularly
deducted a percentage from my paycheck. However, the checks did not itemize the
amount withheld and there were no records of how much he deducted from my
salary. At the end of the year, he never sent me a 1099 form. In other words, he
pocketed the money he was supposedly withholding for the government.

Disgruntled Employee
The employee ALEX who wrote this scathing and scandalous report about my company
was an employee of ANOTHER moving company when he came to OUR company to meet an
employee here in order to pick a fight with him. OUR employee defended himself,
and poor ol' ALEX got his a** whupped big-time. Big Sam Moving has had nothing
to do with this person ALEX for a long time, and we just found his "review"
today (5/4/06).
Normally, a thing like this does not even merit a response, because the company
has a 20-year reputation, and we are well-known and highly respected in this
business. It just twists my knickers that someone who is as jaundiced and
twisted as this guy ALEX, would stoop to such tactics as trying to disparage a
man's business for something he had nothing to do with. The Internet should not
be a forum for pissing contests, but your site seems to thrive on complaints and
stories that cannot be substantiated. I've known Sam for YEARS, and I can tell
you that the report written by ALEX is a downright LIE, and he should be sued
for libel and slander, and this site as an accomplice after the fact.
Big Sam Movers at the phone number cited in the complaint is one of the most
reputable companies in the business. Sam does everything humanly possible to
please, but some people just can't be pleased no matter what you do. ALEX, SHAPE
UP - Someday you'll catch the vein of someone who will "have something for ya'...

I am a current CONTRACT employee of Big Sam Moving -
The "complaint" filed by
"Alex" is utter nonsense, and a complete and total LIE. I am the Webmaster for
the company (if indeed it is the same company "Alex" complains about - which is
doubtful), and so I know a thing or two about how the company operates.
FIRST of all,
employees here are treated with RESPECT.
They are NOT criminals or homeless people as this BOGUS complaint alleges. Big
Sam Moving has been in business over 23 years, and has a great reputation by
word-of-mouth from THOUSANDS of customers who are very satisfied with the
prices, the service, and the way they are treated by the owner and employees.
You don't stay in business for long in the moving business
if your warehouse facility is "dilapidated" or infested with rodents.
SECONDLY - On the issue with employees working here that
“his employees are drug
addicts and dealers, because no one else will remain in his employ for long" -
is RIDICULOUS on its face, as the LAST THING drug addicts
want to do is WORK FOR A LIVING, and DRUG DEALERS make enough money
selling drugs that the last thing THEY would be caught
doing is humping a 600-pound piano up a spiral staircase. As a whole, and
as a rule, employees in the moving business are honest, hard-working people, and
when on occasion, someone who does NOT possess those qualities (like "Alex")
slips through the cracks and makes it into the business, he is SUMMARILY FIRED
when he displeases a customer, or is caught attempting to rip them off (as
"Alex" was caught at another company, and when Sam found out, he refused to hire
him as a permanent employee).
THIRDLY - as for IRS taxes,
the company files its tax
returns every quarter, and has NEVER BEEN AUDITED. Again, the "rip-off
report" filed by "Alex" is ridiculous prima facie, since failing to file tax
returns and failing to file them ON TIME and ACCURATELY will get your business
shut down.
FOUTHLY - The owner of this company has
NEVER stolen anything from a customer.
Possessions stored in the warehouse are inventoried and secured in their own
area of the facility. If boxed, they are wrapped in heavy plastic, and secured
against tampering. There are hidden cameras and people who
watch the warehouse constantly. OCCASIONALLY - someone will leave possessions stored in the warehouse, and for
one reason or another (like they died, etc.) will not pay the storage bills. Big
Sam resolves this by trying to contact the owner or next-of-kin, and when all
attempts fail to contact the owner - usually after many MONTHS of unpaid storage
bills - the company will either DUMP the items in the trash (at its own expense
for carting), or auction off the items in order to recover costs.... but this is
only done as a LAST RESORT.
FINALLY - As articulate and educated as the ONLY "complaint" filed against this
company sounds when reading it, FORENSICALLY - by its own
statements - it can be proven to be a TOTAL FABRICATION. See my Web site

IN CONCLUSION - Take everything (the ONLY thing) NEGATIVE you read about Big Sam
Moving with a "grain of salt". People who are satisfied
with a company do not normally take the time to write the company's praises on
the Internet - but people who are themselves unscrupulous ("Alex"), or
possibly the competition, will go out of their way to unfairly disparage a good
business so that they can have a bigger piece of the business "pie" for
themselves - and they use mediums such as RipOffReport.com to insulate them from
being held accountable for their lies, and as unwitting co-conspirators in LIBEL

The person identified as "Alex" took no such action. He did NOT contact the
department of Transportation, and he did not do so because his ludicrous allegations could not be substantiated, and if he were called to
testify under oath and under penalty of perjury, he could not - even
though he claims to have seen rats run out of customer's furniture, and TAX laws
being violated, etc., ad nauseum - he could not provide one iota of proof that
his LIES are anything but LIES.... If he identified himself, he could be SUED,

business ... consider yourself lucky. ... Think about it. Remember, all

the situation, be nice and not combative, this will show the consumer that you

What consumer would not want to do business with you after seeing how you took

name of good customer service we will make things right with you. However, it is
always best to add some sort of an admission of at least the possibility you or
your company did make a mistake or someone from the company might have made a
mistake, so, in the name of "good customer service make a statement on how you
will be giving the customer the benefit of the doubt and will just issue a
refund." .. this will go a long way! imagine what the consumer is thinking when
they read this ... Even the guilty businesses with real customer service issues
will look responsive (like a hero) and, hopefully, will get tired of making
refunds and change their ways. Yes, this has always been one of the main goals
of Rip-off Report.
EVEN IF YOU ARE NOT A BUSINESS = YOU ARE AN INDIVIDUAL WITH A REPORT(S) FILED
AGAINST YOU? ....
Even if you are an individual and might have pissed off someone in the past, you
need to do what you have to to just make it right with them. Like we stated
above, ... just give them the benefit of the doubt ... file a rebuttal to the
nasty Report about you, state that you had made a mistake in the past and
explain how you've contacted (or are contacting if the rebuttal is your sole
method of contact) the author of the report to make things right with them. You
can also state -- that you don't blame them for being upset with you. ... NOW,
... if you stated something like that on that nasty Report about you, ... after
someone is looking you up on the Internet and reads what you wrote (what we've
suggested here), ... please tell me, who would not want to do business with
someone who took care of a situation like this! ?? We know it works -- from dead
beat dads who did not pay child support to the business that actually ripped
someone off ... they just show how they made things right. - You have to admit,
if you read a complaint that way, you too would now trust that business. We are
told this all the time by businesses. People who once threatened us, cursed us
out and even businesses that sued us and lost (like they all do) .. they all say
to us, they should have handles it this way from the very beginning as we've
suggested to you hear in this email.
Rip-off Report did not invent the Internet,
and with or without Rip-off Report you would be blogged about your business or
just you personally -- and again I say, ... this IS the 21st Century ... True or
false or partly false, right or wrong, . we will all be blogged!
Because so many people just don't get the concept that we know works so well
.... I must reiterate...
FACT: Businesses that admit they may have made a mistake, give their customer
the benefit of the doubt, and show how they took care of the complaint. ... TELL
ME, what consumer would not want to do business with them. Even if the complaint
is totally false but the customer feels in their heart that they were wronged in
some way, you can turn that around by explaining what you know in a nice way,
maybe getting them to still do business with you by replacing the product, or
the sales person, agent etc. .... If handled correctly, you will turn a negative
into a positive.. Either way... The Internet is here to stay, and the tides have
turned for the benefit of the consumer. BIG BUSINESSES with lots of money is no
longer in control. ... This will not change.
Rip-off Report is thanked all the time by businesses that first said, "this will
not work, you are full-of-it!" ... Most Businesses admitted after doing what we
suggested, they now get business from the Report, new found business they would
have never had if the Rip-off Report did not exist.
Those of you that have many complaints and need
more help can always look into Rip-off Report's Corporate
Advocacy, Business Remediation and Customer Satisfaction Program... a
long name for a program that does a lot for both the consumer and businesses
alike.
AGAIN, YOU CAN FILE A REBUTTAL(S) FOR FREE
We DO NOT author the Reports.
Consider yourself lucky the customer did not make
up some sucks.com website on your company located in some 3rd world country
where you could not respond to the charges like you can on Rip-off Report. We
think if you handle your response in the correct way, that will say it all, and
in your favor, turning that negative into a positive, taking the high road.
If a Report is responded to properly, any half intelligent consumer will know
what kind of company or individual you are…
The nicer you are, the more you turn around the possible negativity of a Rip-off
Report. We live in the Internet age. Unless Al Gore pulls the plug on the
internet, we are all stuck with it. :-) Deal with it, and show what a good
business or business person you are: put your best foot forward, go beyond the
call of good customer service, then the Rip-off Report will work as a positive
advertisement you will want ALL your customers to see. Better yet, Rip-off
Report is a lot cheaper than those costly full page ads in the paper,
advertisement on the Internet or on TV. Once you see this is working as a
positive for your company, maybe you will think about donating some of those
advertising dollars. As you will see, Rip-off Report WILL GET YOU NEW FOUND
BUSINESS, if, but only IF, you handle the Report in a positive way. Anyone
thinking of coming after Rip-off Report (filing a lawsuit) will get nowhere and
will only, more than likely, get even more bad publicity, because that lawsuit
is public information.
Rip-off Report has no way of determining whether you or the author of the report
is telling the truth. We encourage you to post a rebuttal explaining your side
of the story, but we have a uniform policy against removing reports posted by
consumers.
I know at this point you don’t want to hear it, but… here are more reasons Why
WE DO NOT Remove any Rip-off Reports:
If we remove a Rip-off Report, we would be no better than the BBB. Although we
do not remove reports, we do provide for the Author of the Report an UPDATE
feature that allows the Author of the Report to supply additional positive or
negative information regarding your business dealings.
Do what’s right – or, what about going beyond the call of good customer service.
The consumer will be surprised and post your response - - you won’t have to
worry about them saying anything bad.. just show that you understand their
point, and make it right with them..!
YOU MUST UNDERSTAND OUR PHILOSOPHY:
If Rip-off Report removed a Report every time a business threatened, consumers
would be back to where they were before. There would be no history of how the
business took care of past problems. This Report on the business or individual
can work as a positive or as a promotional tool if they respond properly and do
the right thing by taking care of their customer. Consumers will see this and
will want to do business with them in spite of what has been written about them.

That is why we supply a REBUTTAL feature so that the company reported has a
chance to respond by agreeing, disagreeing, or apologizing and explaining what
will be done to fix the issue.
By allowing consumers to view the original report, updates, and rebuttals,
consumers will be able to make informed and educated decisions. This is mainly
because consumers will be able to see how the company in question deals with
complaints. All business get them from time to time.
Regardless, as a matter of
policy, we do not remove a submitted Rip-off Report, and we never will.
Some people claim that we remove reports for money, but that is just plain
false. We have been offered as much as $50,000 to remove just one Rip-off
Report, but we declined because doing so is in violation of our policy, and more
importantly, goes against what we what we stand for ... Please understand our
position.
Remember, all businesses will get complaints ... ALL! ... as stated above, at
least file a rebuttal that is pleasant and, if you wish, mention that you
support this forum and freedom of speech -- even if you disagree with what was
said. Whining to consumers about how bad and unfair Rip-off Report is will only
sour their opinion of you.
Also tell what the situation was at the time the Report was posted, even if it's
a long time a ago and how you made improvements to your company to avoid this
and similar things from happening again, and other positive comments about your
company ... that is free. You can turn that negative into a positive! Consumers
are probably finding your business on search engines that would never even know
about you! If handled correctly, this can come permanent positive advertisement!

You may have not mentioned it, but, we know it's always in
everyone's mind that they want to sue us -- usually it's the dishonest companies
that cannot admit wrong doing and could never change their ways that threaten to
sue us..
